These Terms of Service ("Terms") govern your use of the OnHirely platform at onhirely.com ("Service"), operated by OnHirely ("we", "us", "our"). By using the Service, you agree to these Terms.
1. Service Description
OnHirely provides an AI hiring bias audit platform. You upload hiring data and receive compliance reports assessing your automated employment decision tools (AEDTs) against regulations including NYC Local Law 144, California AB 331, Illinois AIPA, and the EU AI Act.
2. Eligibility
You must be at least 18 years old and have the authority to bind the entity you represent to these Terms. The Service is intended for business use by HR professionals, compliance officers, and legal teams.
3. Account Responsibilities
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@onhirely.com if you suspect unauthorized access.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload data you are not authorized to process
- Attempt to reverse-engineer, decompile, or disassemble the Service
- Interfere with the security or performance of the Service
- Resell or redistribute audit reports without authorization
- Use automated tools to scrape or extract data from the Service
5. Your Data
You retain full ownership of all data you upload to OnHirely. We process your data solely to provide the bias audit service. We do not use your data to train AI models, sell to third parties, or for any purpose other than generating your compliance reports.
You are responsible for ensuring you have the legal right to upload and process the hiring data you submit, including any necessary employee or candidate consent.
6. Intellectual Property
The OnHirely platform, including its methodology, user interface, documentation, and underlying technology, is owned by OnHirely and protected by intellectual property laws. Compliance reports generated from your data are licensed to you for your internal business use.
7. Disclaimers
Not legal advice. OnHirely provides data analysis and compliance assessments. Our reports are informational tools to assist your compliance efforts. They do not constitute legal advice and should not replace consultation with qualified legal counsel.
No guarantee of compliance. While our methodology follows EEOC guidelines and applicable regulations, a passing score does not guarantee regulatory compliance. Compliance depends on many factors beyond statistical analysis.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by law, OnHirely shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
9. Pricing and Payment
Paid plans are billed according to the pricing displayed at the time of purchase. We may change pricing with 30 days' notice. Refunds are handled on a case-by-case basis — contact support@onhirely.com.
10. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your data will be deleted according to our Privacy Policy retention schedule.
11. Governing Law
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York County, New York.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on the website at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
